§ 115.37 CONDITIONS FOR CLOSING HOMES.
   (A)   In the event of a conviction by any court of record of any person for a violation of any of the provisions of this subchapter relating to the health, safety and accommodations of patients or residents, the Health Department is authorized to close a nursing home, sheltered care home or home for the aged and to cause its vacation of all residents or patients therefrom, pending the repairs, alterations or additions necessary to make it safe and proper for the occupancy of its patients or residents and to make it comply with this subchapter.
   (B)   Whenever an inspection of such a home discloses that the continued operation of the home would be an immediate and serious menace to public health and safety, the Health Commissioner is authorized to close the home forthwith.
