§ 113.25 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMERCIAL HANDBILL. Any printed or written matter or any sample, device, dodger, circular, leaflet, pamphlet, paper, booklet or other printed or otherwise reproduced original or copy of any matter or literature which:
      (1)   Advertises for sale any merchandise, product, commodity or other thing;
      (2)   Directs attention to a business or mercantile or commercial establishment, or other activity, for the purpose of either directly or indirectly promoting the interest thereof by sales;
      (3)   Directs attention to or advertises a meeting, theatrical performance, exhibition or other event for which an admission fee is charged for the purpose of private gain or profit, but this division shall not apply where an admission fee is charged or a collection is taken up for the purpose of defraying the expenses incident to the event. Nothing contained in this division shall be deemed to authorize the holding, giving or taking place of any such event without a license, where the license is or may be required by any law of this state or under any ordinance or regulation of the city; and/or
      (4)   While containing reading matter other than advertising matter, is predominantly and essentially an advertisement and is distributed or circulated for advertising purposes or for the private benefit and gain of any person so engaged as an advertiser or distributor.
   NONCOMMERCIAL HANDBILL. Any printed or written matter or any sample, device, dodger, circular, leaflet, pamphlet, newspaper, magazine, paper, booklet or other printed or otherwise reproduced original or copy of any matter or literature not included in the definition of “commercial handbill.”
   POLITICAL PAMPHLETS.
      (1)   Any printed or written matter or any sample, device, dodger, circular, leaflet, pamphlet, paper, booklet or other printed or otherwise reproduced original or copy of any matter or literature which:
         (a)   Advertises the credentials, positions, advantages or accomplishments of an individual seeking elective office or of a registered political party or an issue coming before the electorate; or
         (b)   Advertises an opposing position to an individual seeking elective office or to a registered political party or an issue coming before the electorate.
      (2)   In all cases, the POLITICAL PAMPHLET must contain an inscription which is clearly visible, readable and comprehensible, establishing the individual or group responsible for the preparation, printing and distribution of the document and the opinions enumerated therein.
   PRIVATE PREMISES. A dwelling, house, building or other structure, designed or used either wholly or in part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and includes a yard, grounds, walk, driveway, porch, step, vestibule or mailbox belonging or appurtenant to the structure.
   PUBLIC PLACE. Any street, avenue, lane or other public way and any public park, space, plaza, ground or building.
