§ 113.10 SUFFICIENT QUANTITIES.
No person shall advertise for sale at a stated price any item when a sufficient quantity of the advertised item is not readily available to be sold to purchasers at the advertised price during the effective period of the advertisement. As used in this section, “readily available” means available to the customer in an area of the store normally used to display the type of merchandise in question, except in a case where the space available for the item is limited, in which case a sample of the item may be placed in a prominent location, accompanied by a prominent, written notice clearly stating that the item is in stock and may be obtained upon request. “Sufficient quantities” means available in quantities sufficient to meet reasonably expected customer demand through medium response.
