§ 113.02 DECEPTIVE ADVERTISEMENTS AND SALES.
   No person shall use any deception, fraud, false pretense, false promise or misrepresentations or conceal, suppress or omit any material fact with intent that others rely upon the concealment, suppression or omission, in connection with the sale for cash or on credit or advertisement of any merchandise, whether or not any person has in fact been misled. However, nothing in this subchapter shall apply to the owner or publisher of a newspaper, magazine, publication or printed matter wherein such an advertisement appears, or to the owner or operator of a radio or television station which disseminates such an advertisement, when the owner, publisher or operator has no knowledge of the intent, design or purpose of the advertiser. Further, nothing in this subchapter shall apply to any advertisement which is subject to and complies with the rules and regulations of, and the statutes administered by, the Federal Trade Commission.
