§ 94.56 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   FIRE DEPARTMENT. The Chief of the Fire Department or higher designee.
   FIREWORKS. Includes any explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or an audible effect of a temporary exhibitional nature by combustion, explosion, deflagration or detonation, and shall include the following:
      (1)   Firecrackers, torpedoes, skyrockets, Roman candles, bombs or other devices of similar construction;
      (2)   Any fireworks containing any explosive compound; or
      (3)   Any tablets or other devices containing any explosive substance or containing combustible substances producing visual effects.
   FIREWORKS. Shall not include the following:
      (1)   Auto flares;
      (2)   Snake or glow worm pellets;
      (3)   Smoke devices;
      (4)   Trick noisemakers known as “party poppers,” “booby traps,” “snappers,” “trick matches,” “cigarette loads” and “auto burglar alarms;”
      (5)   Sparklers. The term SPARKLERS means a wire or stick coated with pyrotechnic composition which may not exceed 100 grams per item, that produces a shower of sparks upon ignition. The term SPARKLERS shall not include other sparking devices including but not limited to items commonly known as “fountains,” “spinners,” “wheels” or similar devices, the sale and use of which is expressly prohibited;
      (6)   Toy pistols, toy canes, toy guns, other devices in which paper or plastic caps containing twenty-five hundredths grams or less of explosive compound are used, provided they are so constructed that the hand cannot come in contact with the cap when in place for the explosion; or
      (7)   Toy pistol caps or plastic caps which contain less than twenty-five hundredths grams of explosive mixture.
   MUNICIPALITY. The City of Oak Forest.
   POLICE. Any Oak Forest police officer.
