§ 32.117 DISQUALIFICATION OF APPLICANTS FOR CERTAIN OFFENSES.
   (A)   All applicants for positions in the Department of Public Works of the City of Oak Forest are required to possess or obtain an Illinois commercial driver’s license and shall be eligible and qualified to operate city motor vehicles. Therefore, to protect public health, safety and welfare, no person
shall be eligible to apply and test for, accept, or be employed in any position within the Department of Public Works, that is subject to the jurisdiction of the Civil Service Commission, if:
      (1)   The applicant has been convicted of more than two “serious traffic violation” within three years of the date of application for employment. For purposes of this section, “a serious traffic violation” is defined as:
         (a)   A violation of section 11-402(a) of the Illinois Vehicle Code, relating to leaving the scene of an accident involving damage to a vehicle. ILCS Ch. 625, Act 5, § 11-402(a);
         (b)   A violation of section 11-403 of the Illinois Vehicle Code, relating to failure to stop and exchange information after a motor vehicle collision involving property damage only. ILCS Ch. 625, Act 5, § 11-403;
         (c)   A violation of section 11-502(a) of the Illinois Vehicle Code, relating illegal transportation, possession, or carrying of alcoholic liquor within the passenger area of any vehicle. ILCS Ch. 625, Act 5, § 11-502(a);
         (d)   A violation of section 6-101 of the Illinois Vehicle Code, relating to operating a motor vehicle without a valid license or permit. ILCS Ch. 625, Act 5, § 6-101;
         (e)   A violation of Section 11-403 of the Illinois Vehicle Code, relating to failure to stop and exchange information or give aid after a motor vehicle collision involving personal injury or death. ILCS Ch. 625 Act 5, § 11-403;
         (f)   A violation related to excessive speeding, involving speeding over 15 miles per hour over the speed limit;
         (g)   A violation relating to reckless driving;
         (h)   A violation of section 11-707(d) of the Illinois Vehicle Code, relating to passing in a no passing zone. ILCS Ch. 625 Act 5, § 11-707(d);
         (i)   A violation of section 11-1402(b) of the Illinois Vehicle Code, relating to limitations on backing upon a controlled access highway. ILCS Ch. 625, Act 5, § 11-1402(b);
         (j)   A violation of section 11-707(b) of the Illinois Vehicle Code, relating to driving on the left side of a roadway in a non-passing zone. ILCS Ch. 625, Act 5, § 11-707(b);
         (k)   A violation of section 11-1002(e) of the Illinois Vehicle Code, relating to failure to yield the right-of-way to a pedestrian at an intersection. ILCS Ch. 625, Act 5, § 11-1002(e);
         (l)   A violation of section 11-1008 of the Illinois Vehicle Code, relating to failure to yield to a pedestrian on a sidewalk. ILCS Ch. 625, Act 5, § 11-1008;
         (m)   A violation for failure to reduce speed to avoid an accident;
         (n)   A violation for driving too fast for conditions;
         (o)   A violation of Section 11-605 of the Illinois Vehicle Code, relating to exceeding the speed in a school zone. ILCS Ch. 625, Act 5, § 11-605;
         (p)   A violation for improper or erratic traffic lane changes, lane usage and/or center lane usage;
         (q)   A violation for improper passing on the roadway, including, without limitation, a violation for passing on the wrong side of the road or a violation for passing on the shoulder, left or right side;
         (r)   A violation for passing a school bus receiving or discharging passengers or displaying a warning not to pass;
         (s)   A violation of ILCS Ch. 635, Act 5, § 11-710, for following another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway;
         (t)   A violation of section 11-1201, relating to failure to stop for an approaching railroad train or railroad equipment or signals. ILCS Ch. 625, Act 5, § 11-1201; or
         (u)   Any other similar violation of a law or local ordinance of any state relating to motor vehicle traffic control.
      (2)   The applicant’s driver’s license is suspended or revoked at the time of application for employment.
      (3)   The applicant has been convicted of driving under the influence of drugs or alcohol, under any state law or local ordinance in the three year period prior to application for employment.
      (4)   The applicant is unable to obtain an Illinois Commercial Driver’s License within 90 days of the date of hire.
   (B)   The bases for disqualification provided under this section shall be in addition to all other bases for disqualification for employment with the city, under any state or federal law, rules or regulations, or local ordinance, or Civil Service Commission Rule. Nothing contained in this Section shall be construed to limit the authority of the Civil Service Commission to disqualify an applicant from consideration for employment, or discipline an employee up to and including termination.
   (C)   The provisions of this section shall apply to automatically disqualify only new applicants for positions of employment within the Department of Public Works and shall not result in any automatic disqualification of any current employees in the Department of Public Works.
