§ 111.11 TOILET OR LAVATORY FACILITIES FOR SEASONAL FOOD SERVICE ESTABLISHMENTS.
   (A)   A seasonal food service establishment shall not be required to have a toilet room or a lavatory on the premises, provided, however, that the establishment shall make available to its employees a toilet room or a lavatory located within a reasonable distance from the premises of the establishment, which toilet room or lavatory shall be available to such employees during all hours the establishment is open for business.
   (B)   The city’s Health Commissioner shall determine the availability of a toilet room or lavatory and ensure that no health hazards exist or might be created by the lack of a toilet room or lavatory on the premises. The city’s Health Commissioner shall not issue a license to the seasonal food service establishment if no such facilities are available or if a health hazard exists. The city’s Health Commissioner may require that the establishment’s arrangement to make a toilet room or lavatory available be reduced to writing on a form to be provided by the city’s Health Commissioner.
