(A) Upon discovery of a violation of this chapter the city, by its clerk or other duly authorized agent, shall serve or cause to be served a notice of violation upon the owner or occupant of any premises on which garbage is overflowing or the surrounding areas are not clean and free of garbage, and shall demand the abatement of the nuisance within 24 hours.
(B) In the event the nuisance is not abated within 24 hours, the city may proceed to abate the nuisance by removal of the garbage. The owner or occupant shall be responsible for all costs of such abatement including all legal and administrative fees. The minimum charge for such abatement shall be $150.
(C) Neither the city or any of its agents shall be liable for any damage to property occasioned in the enforcement of this section.
