§ 32.094 CONTROL AND EXTINGUISHMENT OF FIRES.
   (A)   Orders of Chief.
      (1)   All persons in the vicinity of a fire or other emergency shall be subject to the orders of the Fire Chief or other members of the Fire Department in charge of the control and extinguishment of the fire.
      (2)   The Chief or other member in charge shall have the power to arrest any person refusing to obey lawful orders issued in accordance with this section and no person shall persist in refusing to obey an order.
   (B)   Cordons. The Fire Chief or other member in charge at a fire or other emergency may prescribe and maintain the limits in the vicinity thereof within which no person shall enter without the permission of the Chief or other member.
   (C)   Removal and destruction of property. The Chief or other member in charge at a fire or other emergency may cause the removal or destruction of any property whenever, in his or her judgment, it becomes necessary to do so to prevent the destruction of property by the communication of fire.
   (D)   Power of arrest. The Chief or other member in command at the scene of a fire or other emergency, or while in charge of fire apparatus or companies, may, at the time an offense is committed, or at any time thereafter, arrest any person suspected of arson, incendiarism or malicious mischief or who conducts himself or herself in a disorderly manner, or who refuses to obey that member while acting in the discharge of duty, or who illegally gives or transmits false alarms, or who wilfully, maliciously or negligently causes damage to fire apparatus or houses.
