§ 32.055 AUXILIARY POLICE.
   (A)   Appointment and termination. The Mayor, with the advice and consent of Council, may appoint auxiliary police officers in such number as the Mayor and Council from time to time deem necessary. The appointment of any or all auxiliary police officers may be terminated by the Mayor subject to the advice and consent of Council.
   (B)   Status in Police Department. Auxiliary police officers shall not be considered to be members of the regular Police Department and shall not supplement members of the Department in the performance of their assigned and normal duties, except as otherwise provided in this subchapter.
   (C)   Qualifications. Prior to appointment, all auxiliary police officers shall:
      (1)   Be fingerprinted and the fingerprints shall be checked with the Federal Bureau of Investigation for any possible criminal record;
      (2)   Be 21 to 35 years of age, except that if the applicant is over 35 years of age, the age limit may be extended one year for each year of previous police experience of the applicant;
      (3)   Be examined and approved as physically fit by a medical doctor designated by the Mayor and Council;
      (4)   Possess at least a high school diploma;
      (5)   Pass a physical agility test, which test shall be per the specifications and under the direction of the Chief of Police;
      (6)   Pass a personality test, which test shall be per the specifications and under the direction of the Chief;
      (7)   Pass a written aptitude test, which test shall be per the specifications and under the direction of the Chief;
      (8)   Pass background checks as might be requested by the Chief; and
      (9)   Take and pass an oral examination to be given by a board of regular and auxiliary police officers, which board shall be appointed by and be under the direction of the Chief.
   (D)   Identification symbols; control by Chief. Identification symbols worn by auxiliary police officers shall be different and distinct from those used by the regular Police Department and shall be selected and chosen by the Chief of Police. Auxiliary police officers shall, at all times during the performance of their duties, be subject to the direction and control of the Chief.
   (E)   Powers and duties. An auxiliary police officer shall be a conservator of the peace and shall have the following powers and duties:
      (1)   To aid or direct traffic within the municipality;
      (2)   To aid in the control of natural or human-made disasters;
      (3)   To aid in cases of civil disorder as directed by the Chief of Police. In cases which render it impractical for the members of the regular Police Department to perform normal and regular police duties, the Chief is authorized to assign auxiliary police officers to perform normal and regular police duties;
      (4)   To arrest or cause to be arrested, with or without process, all persons who break the peace or are found to be violating any municipal ordinance or any criminal law of the state;
      (5)   To commit arrested persons for examination;
      (6)   If necessary, to detain arrested persons in custody overnight or Sunday in any safe place or until they can be brought before a proper judicial officer;
      (7)   To exercise all other powers as conservators of the peace that the Mayor and Council may prescribe; and
      (8)   To serve and execute all warrants for violations of municipal ordinances or state criminal laws within the city limits, and for this purpose to have all the common law and statutory power of sheriffs.
   (F)   Carrying firearms. Auxiliary police officers shall not carry firearms, except with the permission of the Chief of Police, and then only when in uniform and in the performance of their duties.
   (G)   Weapons training.
      (1)   Auxiliary police officers, prior to entering upon any of their duties, shall receive a course of training in the use of weapons and other police procedures by the Chief of Police.
      (2)   The course shall be not less than ten hours in duration.
      (3)   Upon completion of the course, the Chief shall file with the City Clerk a certificate attesting to the auxiliary police officer’s completion of the course.
   (H)   Compensation. Auxiliary police officers shall be paid for each hour of service performed, at a rate set by Council, provided that the service is performed at the direction of the Chief of Police.
