§ 32.002 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CODE. Any municipal ordinance, law, rule, regulation or code, inclusive, except ordinances for which the potential penalty described therein includes a period of incarceration.
   HEARING OFFICER. A person recommended by the Police Chief and then appointed by the Mayor with the advice and consent of the City Council to preside over administrative hearings as set forth in this subchapter.
   OWNER.
      (1)   For the purpose of a violation relating to real property, the person to whom the County Collector sent the last ascertainable tax bill; and
      (2)   For the purpose of a violation relating to motor vehicles, the person to whom the motor vehicle is registered, as provided by the records of the Secretary of State of Illinois. Any person so described herein may present evidence to overcome the presumption that the person is the OWNER of the property and/or motor vehicle for which the person received a notice of violation. Except as otherwise provided in this subchapter or as circumstances reasonably dictate, all notices described in this subchapter shall be sent to the owner at the following address:
         (a)   For the purpose of a violation relating to real property, the address to where the County Collector sent the last tax bill; and
         (b)   For the purpose of a violation relating to motor vehicles, the address to where the motor vehicle is registered, as provided by the records of the Secretary of State of Illinois.
