§ 157.09 FENCES; INSPECTIONS BY BUILDING DEPARTMENT.
   (A)   A private residential swimming pool shall be enclosed by a fence. All fence openings or points of entry into the pool area enclosure shall be equipped with gates. The fence and gates shall be four feet in height above the walk grade level. The fence shall enclose all sides of the swimming pool. All gates shall be equipped with a latching device not less than six inches from the top of the gate. The fence and gates shall be constructed of a minimum number 9 gauge woven wire mesh corrosion resistant material, or, in the case of wood fences, the construction method may be of any type approved by the Building Commissioner. All fence posts shall be decay or corrosion resistant and shall be set in concrete bases.
   (B)   An above-ground pool shall be fenced with a fence of the type described in division (A) above, or a fence permanently affixed to the railing of the pool complying with all other provisions of division (A) above. No gap of more than three inches will be permitted between the lower rail of the fence and the top of the pool wall.
   (C)   Inspections will be carried out by the Building Department or an authorized representative of the city, with pool safety and public welfare being the prime considerations.
