§ 156.34 MAINTENANCE AND REMOVAL OF TELECOMMUNICATIONS FACILITIES, TOWERS AND ANTENNAS.
   (A)   All telecommunications facilities, towers and antennas, including satellite dishes, shall be maintained in compliance with all standards in applicable building and technical codes to ensure the structural and technical integrity of the facilities.
   (B)   The Director or his or her designee shall be authorized to enter upon the property of the owner or tenant of the antenna facility for purposes of inspecting same, upon prior written or verbal notice to the owner or tenant.
   (C)   If upon inspection by the Director, it is determined that a telecommunications facility, tower or antenna fails to comply with any of the applicable standards of the Oak Forest Building Codes, the Director shall send a written notice of the violation to the owner of the telecommunications facility, tower or antenna and the owner is different from the owner of such facility. The notice shall be mailed by certified mail, return receipt requested.
   (D)   The owner of the telecommunications facility, tower or antenna and the owner of the property if the owner is different from the owner of the facility, shall have 30 days after receipt of the violation notice to bring the facility into compliance.
   (E)   In the event the telecommunications facility, tower or antenna is not brought into compliance within the required 30-day period, the city may provide notice to the owners requiring such a facility to be removed.
   (F)   In the event the telecommunications facility, tower or antenna is not removed within 30 days after receipt of the notice of removal, the city may remove or cause the removal of the facility and file a lien against the property for the costs of removal.
   (G)   In the event that the failure of the telecommunications facility, tower or antenna to comply with any such standards constitutes a present danger to persons or property, the city may abate the danger, provide notice to the owner as soon as reasonably practicable and recover the costs of abatement from the owner and file a lien against the property for the costs of abatement.
   (H)   The city may pursue any and all available legal remedies to insure that a telecommunications facility, tower or antenna which fails to comply with the Oak Forest Building Code or which constitutes a danger to persons or property is brought into compliance or removed.
   (I)   Any delay by the city in taking enforcement action against the owner or a telecommunications facility, tower or antenna and the owner of the property if the owner is different from the owner of the facility, shall not waive the city’s right to take any action at a later time.
   (J)   The city may seek to have the telecommunications facility, tower or antenna removed regardless of the owner’s or operator’s intent to the facility, and regardless of any permits, federal, state or otherwise, which may have been issued or granted.
