§ 151.152 SUSPENSION OR REVOCATION OF CERTIFICATES OF REGISTRATION.
   (A)   Whenever, upon inspection of a development or conversion/dwelling unit for initial registration or renewal of a certificate of registration, the Building Commissioner finds that conditions or practices exist which are in violation of this subchapter, or of any applicable provision of these codified ordinances or an applicable rule or regulation promulgated pursuant thereto, the Building Commissioner shall serve the designated agent or owner of the dwelling unit with notice of the violation. The notice shall state that unless the violation cited is corrected within not less than five days, except for emergency situations, the certificate of registration may be suspended.
   (B)   At the end of the time, the Building Commissioner has allowed for correction of any violation cited, the Building Commissioner or his or her duly authorized designee shall reinspect the development or conversion/dwelling unit and, if he or she determines that the violation has not been corrected, he or she may issue an order suspending the certificate. The order shall take effect five days following service upon the designated agent or owner of the dwelling unit unless, in the interim, the development or unit owner requests, in writing, a hearing.
   (C)   Any person whose certificate of registration is subject to suspension pursuant to a suspension order shall be entitled to a hearing on the suspension action by filing with the City Clerk a written receipt for a hearing before the Building Inspection Review Board within two business days following the receipt of the suspension order. Upon receipt of the request, a hearing shall be scheduled to be held before the Board not more ten business days thereafter. Upon completion of the hearing, the Board may either:
      (1)   Confirm the suspension;
      (2)   Suspend the suspension and allow additional compliance time; or
      (3)   Rescind the suspension.
   (D)   If no petition for reconsideration of a suspension order is filed as provided herein, the suspension order shall remain in effect until the violation in question has been corrected, as determined by the Building Commissioner upon inspection of the development or conversion/dwelling unit.
   (E)   If a certificate of registration is suspended, and the suspension is affirmed after hearing, if any, during the period of suspension the following apply:
      (1)   The city may seek enforcement of any applicable law; and
      (2)   The city may seek the imposition of penalties as provided by this code.
