§ 135.04 FURNISHING ALCOHOL TO UNDERAGE PERSONS.
   (A)   It is unlawful for a person to, in the city:
      (1)   Sell, give, deliver or dispense alcoholic liquor to an underage person;
      (2)   Knowingly permit or knowingly or negligently fail to prevent, on premises under his or her control, the consumption of alcoholic liquor by an underage person;
      (3)   Knowingly permit or knowingly or negligently fail to prevent the operation of a motor vehicle in his or her control by an underage person when the person knows or in the exercise of ordinary judgment should have known that the underage persons had consumed any amount of alcoholic liquor within two hours prior to when the permission was granted or prior to the operation;
      (4)   Sell, give or furnish to an underage person a false or fraudulent identification card of the underage person;
      (5)   Sell, give or furnish to an underage person an identification card of any other person; and/or
      (6)   Pay for or rent a hotel or motel room or facility for the purpose of or knowing that the room or facility is to be used by an underage person for the unlawful consumption of alcoholic liquor.
   (B)   Divisions (A)(1) and (2) of this section shall not apply to:
      (1)   The giving, delivering or dispensing of alcoholic liquor to an underage person, or the permitting of the consumption of alcoholic liquor by an underage person, in the performance of a religious service or ceremony; or
      (2)   The giving, delivering or dispensing of alcoholic liquor to an underage person, or the permitting of the consumption of alcoholic liquor by an underage person, under the direct supervision and approval of that underage person’s parent in the privacy of a home.
   (C)   The following shall apply to division (B)(2) of this section: In any prosecution of a person for the commission of any state or local offense when the person was an underage person, the prosecutor, upon reasonable grounds to so believe, may request a ruling as to whether the consumption of alcoholic liquor, as permitted by the person’s parent, caused the commission of the offense. If it is so determined in the affirmative, then divisions (A)(1) and (2) of this section shall apply.
