For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ACT. UCA §§ 11-36a-101 et seq., entitled Impact Fees Act, or any successor enactment of said statute.
CAPITAL FACILITIES PLAN. Those portions of the town culinary water master plan which pertain to the town’s capital facilities, including the improvement or expansion of the town’s culinary water system, as the same may be amended from time to time.
DEVELOPMENT ACTIVITY. Any construction or expansion of a building, structure or use, any changes in use of a building or structure, or any change in the use of land that creates additional demand and need for public facilities.
DEVELOPMENT APPROVAL. Any written authorization from the town that authorizes the commencement of development activity.
IMPACT FEE. A payment of money imposed upon development activity as a condition of development approval. IMPACT FEE does not mean a tax, a special assessment, a building permit fee, a hook-up fee, a fee for project improvements or other reasonable permit or application fees.
PROJECT IMPROVEMENTS. Site improvements and facilities that are:
(1) Planned and designed to provide service for development resulting from a development activity; and
(2) Necessary for the use and convenience of the occupants or users of the development resulting from a development activity.
SERVICE AREA. The geographic area designated by the town in which a defined set of public facilities provides service within the area.
TOWN. Oak City, Utah, a Utah municipal corporation.
