(A) Requirements.
(1) It shall be unlawful for any person to disinter any body buried in said cemetery, except under direction of the Cemetery Superintendent or order of a court of competent jurisdiction. The Cemetery Superintendent shall not order any grave opened unless:
(a) A permit from the county’s Health Officer has been issued; or
(b) A written order from the owner of the lot authorizing such removal has been filed with the town. All such removals shall be recorded in a book kept for such purposes.
(2) It shall be unlawful for any person to disinter the body of a person whose death was caused by a contagious disease unless two years has past since his or her burial. This division (A)(2) shall not apply to bodies buried in hermetically sealed coffins.
(3) It shall be unlawful to inter anything other than human remains in the town cemetery.
(4) It shall be unlawful to inter a human body in a location that is not a legal cemetery, whether a private cemetery or cemetery of the town, unless by special permission of the Town Council under such rules and regulations that it may apply.
(B) Indigents. The Cemetery Superintendent may designate a portion of the cemetery to the burial of indigents. The Mayor shall have authority to determine indigence for the purposes of burial in the cemetery. The Mayor shall have the duty to disclose to the Town Council all deceased persons declared indigent for the purposes of this chapter.
(C) Vaults for caskets required.
(1) It shall be unlawful for any person to be buried in the cemetery unless the casket shall be placed in a vault made of concrete, steel or brick that covers the casket on all six sides.
(2) No wood shall be used as a permanent part of the construction of any part of the vault.
