(A) For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(B) If, in the judgment of the Superintendent of Water, or any other officer of the town, a water user engages in any practice which results in the needless waste of water, per § 50.29 of this chapter, the following penalties may be applied:
(1) First infraction: the user shall receive a warning and have his or her name placed on a check-back list;
(2) Second infraction: requires the payment of a $25 fine; and
(3) Third infraction: shall be considered a Class B misdemeanor, which is punishable by a fine as provided in § 10.99 of this code of ordinances.
