§ 33.009 PART-TIME POLICE OFFICERS.
   (A)   Employment. The city may employ part-time police officers from time to time as the City Council deems necessary. "Part-time police officer" means a law enforcement officer who is a member of the city's police department and who is employed by the city 1,560 hours or less in any calendar year.
   (B)   Appointment. The Mayor, with and by the consent of the City Council, is hereby authorized and empowered to appoint part-time police officers as from time to time may be requested by the Chief of Police.
   (C)   Hiring standards. To be hired as a part-time police officer, an applicant shall meet the following standards:
      (1)   Be of good moral character, of temperate habits, excellent physical and mental condition and physically and mentally able to perform the assigned duties.
      (2)   Be at least 21 years of age.
      (3)   Prior to appointment, the applicant shall pass a medical examination and furnish an affidavit from a registered medical doctor attesting to his or her physical condition.
      (4)   Possess a high school diploma or GED certificate.
      (5)   Possess a valid Illinois driver's license.
      (6)   Prior to appointment, the applicant shall be fingerprinted and a background check performed. The applicant may not have been convicted of a felony or other crime involving moral turpitude.
      (7)   If the applicant served in the military, he or she shall have been honorably discharged.
   (D)   Rules and regulations. Persons appointed as part-time police officers shall be subject to rules and regulations governing regular police officers of the city and to such special rules and regulations as may from time to time be promulgated by the Chief of Police.
   (E)   Assignments; direction. The Chief of Police is hereby authorized and empowered to assign part-time police officers as the Chief may deem expedient for the everyday and emergency operations of the Police Department. Part-time police officers shall at all times during the performance of their duties be subject to the direction and control of the Chief of Police.
   (F)   Discipline; termination of appointment. Part-time police officers shall be under the disciplinary jurisdiction of the Chief of Police. Part-time police officers shall not have any property rights in their employment. The Mayor may remove any part-time police officer, on any written charge, whenever the Mayor is of the opinion that the interests of the city demand such removal. The Mayor shall report the reasons for the removal to the corporate authorities at a meeting to be held not less than five nor more than ten days after the removal. If the Mayor fails or refuses to report to the corporate authorities the reasons for the removal, or if the corporate authorities by a two-thirds vote of all members authorized by law to be elected disapprove of the removal, the part-time police officer thereupon shall be restored. The vote shall be by yeas and nays, which shall be entered upon the journal of the corporate authorities. Upon restoration, the part-time police officer shall give a new bond and take a new oath of office. No part-time police officer shall be removed a second time for the same offense. Any person whose appointment has been terminated shall immediately return to the Chief of Police the commission card of appointment, badges, cap pieces and other Police Department property held by him or her.
   (G)   Compensation. The hourly wage rate for part-time police officers of the city shall be such as may from time to time be prescribed by the City Council. If any person requests the services of a part-time police officer or officers for any specific purposes, these services must be approved by the Chief of Police according to the city's Secondary/Off-Duty Employment and Special Details Policy, as amended from time to time, as prescribed by the City Council.
   (H)   Fitness for duty. Any part-time police officer who is admitted to any medical institution for any period over 24 hours, or who is injured to such an extent as to be unable to perform the duties of a part-time police officer shall, prior to reporting for duty, obtain from a licensed physician an affidavit attesting to the part-time police officer's good health and stating that such part-time police officer is fit to return to duty.
   (I)   Powers and duties; identification.
      (1)   Part-time police officers shall be members of the regular Police Department of the city, except for pension purposes. Part-time police officers shall not be assigned under any circumstances to supervise or direct full-time police officers of a police department. Part-time police officers shall not be used as permanent replacements for permanent full-time police officers. Part-time police officers shall not supplement members of the regular Police Department of the city in the performance of their assigned and normal duties, except as otherwise provided in this section.
      (2)   Part-time police officers shall only be assigned to perform the following duties in a municipality:
         (a)   To act as an automated traffic law enforcement system review technician to review and approve the determinations of the technician that a motor vehicle was being operated in violation of § 11-208.6 of the Illinois Vehicle Code or the provisions of this code;
         (b)   To aid or direct traffic within the city;
         (c)   To aid in control of natural or manmade disasters;
         (d)   To aid in case of civil disorder as directed by the Chief of Police; and
         (e)   To exercise the powers of a conservator of the peace.
      (3)   Notwithstanding the foregoing, when it is impractical for members of the regular Police Department to perform their normal and regular police duties, the Chief of Police may assign part-time police officers to perform such normal and regular police duties.
      (4)   Identification symbols worn by part-time police officers shall be different and distinct from those used by members of the regular Police Department.
      (5)   Part-time police officers shall not carry firearms, except with the permission of the Chief of Police and while in uniform and in the performance of their duties.
   (J)   Training. Before entering upon any of their duties, part-time police officers shall be trained under the Intergovernmental Law Enforcement Officer's In-Service Training Act in accordance with the procedures for part-time police officers established by the Illinois Law Enforcement Training Standards Board. A part-time police officer who has not yet received certification under Section 8.2 of the Illinois Police Training Act shall be directly supervised at all times by a law enforcement officer certified by the Illinois Law Enforcement Training Standards Board. Direct supervision shall include oversight and control with the supervisor having final decision making authority as to the actions of the probationary part-time police officer during duty hours. A person hired to serve as a part-time police officer must obtain from the Illinois Law Enforcement Training Standards Board a certificate (i) attesting to his or her successful completion of the part-time police training course; (ii) attesting to his or her satisfactory completion of a training program of similar content and number of hours that has been found acceptable by the Illinois Law Enforcement Training Standards Board under the provisions of the Illinois Police Training Act; or (iii) attesting to the Illinois Law Enforcement Training Standards Board's determination that the part-time police training course is unnecessary because of the person's extensive prior law enforcement experience. A part-time police officer who is hired and who has not yet received certification under Section 8.2 of the Illinois Police Training Act hired must obtain this certificate within 18 months after the initial date of hire. A part-time police officer who has not yet received certification under Section 8.2 of the Illinois Police Training Act must be enrolled and accepted into a Illinois Law Enforcement Training Standards Board approved course within six months after active employment by the city. The city may seek a waiver from the Illinois Law Enforcement Training Standards Board extending the period for compliance. A part-time police officer who has not yet received certification under Section 8.2 of the Illinois Police Training Act may not practice as a part-time police officer during the waiver period. If training is required and not completed within the applicable time period, as extended by any waiver that may be granted, then the part-time police officer shall forfeit his or her position. Before being permitted to carry a firearm, however, a part-time police officer must have the same course of training as required of peace officers under Section 2 of the Peace Officer Firearm Training Act. Training required by Section 2 of the Peace Officer Firearm Training Act must be completed by a part-time police officer within six months from the date of the part-time police officer's initial employment.
   (K)   Line of duty compensation. The Line of Duty Compensation Act shall be applicable to part-time police officers upon their death in the line of duty as described in this section.
