§ 33.008 DEPUTY CHIEF OF POLICE.
   (A)   The position of Deputy Chief of Police is hereby created. The Deputy Chief of Police position shall be an exempt rank immediately below that of the Chief of Police.
   (B)   The Deputy Chief of Police shall assist the Chief of Police in managing and administering the Police Department including, among other duties, assignments given from time to time by the Chief of Police. In the event that there is a vacancy in the office of Chief of Police or in the event that the Chief of Police is incapacitated or otherwise not able to perform his duties, the Deputy Chief of Police shall have the same powers and duties generally as that of Chief of Police, during any vacancy in the office or during the absence or incapacity of the Chief of Police.
   (C)   The Mayor may appoint the Deputy Chief of Police with the advice and consent of the city council. The Chief of Police may make a recommendation of a Deputy Chief of Police to the Mayor. The Deputy Chief of Police shall be appointed from the ranks of sworn, full-time officers of any Illinois law enforcement agency provided that he or she has at least five years of full-time service as a police officer.
   (D)   If the Deputy Chief of Police is appointed from the ranks of sworn, full-time officers of the city, the Deputy Chief of Police shall be permitted, regardless of rank, to take promotional examinations and may be promoted to a higher rank than he or she then holds without having to resign as Deputy Chief of Police. If the Deputy Chief of Police was appointed from the ranks of sworn, full-time officers of the city and is removed from the position, he or she shall revert to the rank held immediately prior to the appointment to the Deputy Chief of Police position, provided, however, that if the Deputy Chief of Police shall have been promoted to a higher rank during his or her tenure as Deputy Chief of Police, he or she shall revert to the rank to which he or she was promoted during his or her tenure as Deputy Chief of Police.
   (E)   The compensation of the Deputy Chief of Police shall be set from time to time by the city council.
