Unless a cable operator has obtained a state-issued authorization pursuant to § 21-401 of the Public Utilities Act ( ILCS Ch. 220, Act 5, § 21-401), a cable franchise shall be required of any cable operator, which may, under the Cable Act (47 U.S.C. §§ 521 et seq.) and ILCS Ch. 65, Act 5, § 11-42-11, be required to obtain a cable franchise. The provisions of this chapter are applicable to telecommunications franchises and open video systems, except as may be otherwise provided by preemptive state or federal law; in which case, the provisions of this chapter shall apply to the maximum extent legally possible.
