The following deletions, modifications and amendments to the County Ordinance shall be effective and applicable in the city:
(A) Section 16-12. (Definitions) is amended by:
(1) Deleting the definition for COMMITTEE in its entirety, and replacing it with the words THE STORMWATER OVERSIGHT COMMITTEE OF THE CITY.
(2) Deleting the definition of DEPARTMENT in its entirety, and replacing it with the words THE CITY’S DEPARTMENT OF PUBLIC SERVICES.
(3) Deleting the definition of DIRECTOR in its entirety, and replacing it with the words THE CITY’S DIRECTOR OF PUBLIC SERVICES.
(4) Adding the following to the list of definitions: CITY. The City of Oakbrook Terrace, Illinois.
(B) Section 16-31 (Participating Communities) is amended by deleting the word “Department” in paragraphs lb, lc, and le, and replacing it with the words “DuPage County Stormwater Management Division”.
(C) Section 16-33 (Duties of Director) is amended by deleting the word “communities” in paragraph 3, and replacing it with the words “DuPage County Stormwater Management Committee”.
(D) Section 16-34 (Representative Capacity) is amended by deleting the word “County”, and replacing it with the word “City”.
(E) Section 16-42 (Prohibitions of Illicit Connections) is amended by deleting the word “Department” in the last sentence of paragraph 5, and replacing it with the words “DuPage County Stormwater Management Division”.
(F) Section 16-50 (Submission of Notice of Intent (NOI) to the Department) is amended by deleting the word “Department” in paragraphs 1, 2, and 3, and replacing it with the words “DuPage County Stormwater Management Division”.
(G) Section 16-56 (Compliance Monitoring) is amended by deleting the word, “Department”, in paragraph lb, and replacing it with the words, “DuPage County Stormwater Management Division”.
(H) Section 16-62 (Notice to Correct Violations: Director May Take Action) is amended by deleting the words “County of DuPage” from paragraph 2, and replacing them with the words “City of Oakbrook Terrace”.
(I) Section 16-66 (Fines) is hereby deleted in its entirety, and the following is substituted: In addition to all other remedies provided for in Article 8 of the County Ordinance, any person who violates any provision of this chapter shall, upon conviction, be subject to a fine of not less than $75 and not more than $1,000 and each and every day or portion of a day during which the violation is committed, continued or permitted shall constitute a separate offense and shall be punishable by such a fine.
(J) Section 16-86 (Right of Appeal) is amended by:
(1) Deleting the words “Stormwater Committee of the DuPage County Board” from paragraph 1, and replacing them with the word “Committee”.
(2) Deleting the words “County Board” from paragraphs 3 and 4, and replacing them with the words “City Council”.
