(A) General conditions.
(1) No dwelling units shall be permitted.
(2) No Adult-Use Cannabis Business Establishment shall be permitted.
(B) Permitted uses.
(1) Service facilities, but only in compliance with § 156.051, and only on such portion of the property that is not used specifically for burial plots. (Am. Ord. 07-51, passed 4-22-08)
(2) Buildings or structures for the maintenance and/or storage of motor vehicle equipment, inventory, parts, or supplies used in the maintenance or operation of a permitted use.
(3) Cemeteries.
(4) Columbaria.
(5) Crematories.
(6) Funeral parlors.
(7) Mausoleums.
(8) Municipal buildings, structures and water storage and distribution facilities.
(C) Special uses.
(1) Planned unit developments according to the requirements of § 156.025.
(2) Highway advertising signs regulated by § 156.052 of this code.
(D) Floor area ratio. The floor area ratio for municipal buildings or structures shall not exceed 0.05. Except as provided herein, the floor area ratio for all other buildings or structures shall not exceed 0.5. For purposes of determining floor area ratio in a B-6 zoning district, any structures or buildings, crypts, monuments, or private mausoleums which are used exclusively for the interment of human remains and contain no internal areas suitable for regular visitation by persons or individuals shall not be considered a building or structure for purposes of determining floor area ratio. Any other building or structure shall be included for purposes of determining floor area ratio.
(E) Lot area. The minimum lot area shall not be less than one acre.
(G) Yard areas. No building or structure shall be erected or enlarged unless the following yards are provided and maintained:
(1) The minimum required yards for buildings or structures shall be 30 feet from any perimeter property line. Paved areas shall not be located closer than ten feet from the front lot line of the parcel; five feet from the side lot line of the parcel, provided that paved areas adjacent to a residential district shall not be located closer than 20 feet from the side lot line of the parcel; and five feet from the rear lot line of the parcel.
(2) No minimum yard requirements shall apply to any property to be used for a municipal building, structure or water storage and distribution facility.
(3) The minimum required yard for burial plots shall be five feet from any perimeter property line.
(4) No minimum yard requirements shall apply to highway advertising signs which are regulated by § 156.052 of this code.
(H) Building heights. The maximum height for a building or structure other than highway advertising signs, shall be 25 feet; provided that there shall be no maximum height for any municipally owned water storage facility.
(I) Landscaping. Property shall be kept in clean and neat appearance, shall be landscaped in accordance with the landscaping requirements of § 156.049, and plans for the installation of such landscaping shall be provided to and approved by the Director of Community and Economic Development prior to the issuance of permits.
(J) Existing structure and uses. Any and all uses, structures, buildings, roadways, or other facilities of any cemetery, mausoleum or crematory, which were existing as of the date of passage of this section, on property which is or becomes annexed to the city, shall be deemed permitted uses, structures, buildings, roadways and facilities which may be used, operated, maintained, repaired, replaced, or reconstructed; provided, however, that any annexation agreement may provide for a schedule for the removal or replacement of any of these uses.
(K) Nonconforming uses. As provided in § 156.085(L).
