§ 136.20 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CANNABIS. Includes marihuana, hashish, and other substances which are identified as including any parts of the plant Cannabis Sativa, whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and any compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds, or resin, including tetrahydrocannabinol (THC) and all other cannabinol derivatives, including its naturally occurring or synthetically produced ingredients, whether produced directly or indirectly by extraction, or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis; but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination. CANNABIS does not include industrial hemp as defined and authorized under the Industrial Hemp Act. CANNABIS also means cannabis flower, concentrate, and cannabis-infused products.
   CASUAL DELIVERY. The delivery of not more than 10 grams of any substance containing cannabis without consideration.
   DELIVER or DELIVERY. The actual, constructive, or attempted transfer of possession of cannabis, with or without consideration, whether or not there is an agency relationship.
   MANUFACTURE. The production, preparation, propagation, compounding, conversion, or processing of cannabis, either directly or indirectly, by extraction from substances of natural origin, independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of cannabis, or labeling of its container, except that this term does not include the preparation, compounding, packaging, or labeling of cannabis as an incident to lawful research, teaching, or chemical analysis, and not for sale.
   PRODUCE or PRODUCTION. Planting, cultivating, tending, or harvesting.
   PUBLIC PLACE. Any place where a person could reasonably be expected to be observed by others, including, but not limited to, all parts of buildings owned in whole or in part, or leased, by the State of Illinois, or the City of Oakbrook Terrace, or any other public entity. PUBLIC PLACE does not include a private residence unless the private residence is used to provide licensed child care, foster care, or other similar social service care on the premises.
   SUBSEQUENT OFFENSE. An offense under §§ 136.02 through 136.05 the offender of which, prior to his conviction of the offense, has at any time been convicted under these sections or under any laws of the United States, this state, or of any state relating to cannabis or any controlled substance as defined in the Illinois Controlled Substance Act, ILCS Ch. 720, Act 570, §§ 100 et seq.
   TETRAHYDROCANNABINOL. Including without limitation, the following:
      (1)   Delta-1-cis- or trans- tetrahydrocannabinol;
      (2)   Delta-6-cis- or trans- tetrahydrocannabinol, and its optical isomers;
      (3)   Delta-3.4-cis- or trans- tetrahydrocannabinol, and its optical isomers;
      (4)   Delta-10-cis- or trans- tetrahydrocannabinol, and its optical isomers;
      (5)   Delta-8-tetrahydrocannabinol acetate 8 ester;
      (6)   Delta-9-tetrahydrocannabinol acetate 10 ester;
      (7)   Delta-6a-, 10a-tetrahydrocannabinol acetate ester;
      (8)   Delta-10-tetrahydrocannabinol acetate ester;
      (9)   A product derived from industrial hemp that was produced as a result of a chemical process that converted the industrial hemp or a substance contained in the industrial hemp into Delta-8, Delta-9, Delta-6a, 10a, or Delta-10 tetrahydrocannabinol, including their respective acetate esters; and
      (10)   Any other psychoactive substance derived therein.
   TETRAHYDROCANNABINOL PRODUCT. Any product containing tetrahydrocannabinol used for human consumption.
