§ 114.04 PROHIBITED SALES; SIGNS.
   (A)   No person, including any licensee, shall sell any tobacco products to any person under 18 years of age.
   (B)   (1)   Any person operating a business selling tobacco products, or where vending machines are located, shall post, in a conspicuous place upon the premises or machine, a sign which shall be imprinted with the following statement:
"THE SALE OF TOBACCO PRODUCTS AND SMOKING ACCESSORIES TO PERSONS UNDER EIGHTEEN YEARS OF AGE OR THE MISREPRESENTATION OF AGE TO PROCURE SUCH A SALE IS PROHIBITED BY LAW."
      (2)   The text of such signs shall be in red letters on a white background, and the letters thereon shall be at least one inch high.
   (C)   No person shall sell a bidi cigarette to another person.
   (D)   Except for a person operating a business selling tobacco products, no person shall sell cigarette paper. No person shall sell cigarette paper from a vending machine.
   (E)   No person shall sell tobacco products in a vending machine unless such tobacco products are not placed together with any non-tobacco product, other than matches, and unless such vending machine is located in one of the following places:
      (1)   Places to which minors under 18 years of age are not permitted access;
      (2)   Places where alcoholic beverages are sold or consumed on the premises and vending machine operation is under the direct supervision of the owner or manager; and
      (3)   Places where the vending machine is locked and can only be operated by the owner or an employee over 18 years of age, either directly or through a remote control device if the device is accessible to all customers.
   (F)   No person shall sell a tobacco product, including a single or loose cigarette that is not contained within a sealed container, pack or package, as provided by the manufacturer, which container, pack or package bears the health warning required by federal law.
   (G)   No person shall buy for, or distribute samples of or furnish any tobacco products to any person under 18 years of age.
