(A) If a licensee, its liquor manager or any employee believes, has reason to believe or should have reason to believe, that a sale or delivery of alcoholic liquor is prohibited because the prospective recipient is underage, as provided in § 111.023(A), then, before making such sale or delivery, the licensee, its liquor manager or an employee shall demand presentation of positive identification issued by a federal, state, county or municipal government, or a subdivision or agency thereof , and containing proof of age and a picture of the holder thereof. A traffic citation shall not be accepted as identification or as evidence of age; however, the following documents issued by a federal, state, county or municipal government, or a subdivision or agency thereof, shall constitute adequate proof of age:
(1) A motor vehicle operator's license;
(2) A registration certificate issued under the Federal Selective Service Act; or
(3) An identification card issued to a member of the Armed Forces.
(B) No person under the age of 21 years shall present or offer to any licensee, its liquor manager or any employee, any written, printed or photostatic evidence of age and identity that is false, or not actually his or her own for the purpose of ordering, purchasing, attempting to purchase or otherwise procuring or attempting to procure the serving of any alcoholic beverage, or have in his or her possession any false or fraudulent written, printed or photostatic evidence of age and identity.
(C) No person shall misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor in any place in the city where alcoholic liquor is sold at retail.
(D) If a licensee, its liquor manager or any employee believes, or has reason to believe that any person has presented identification for the purpose of purchasing or obtaining alcoholic liquor which has been altered, forged or defaced for the purpose of misrepresenting the person's age, such licensee, its liquor manager or an employee, shall confiscate such identification, and if the person presenting such identification remains on the licensed premises, the licensee, its liquor manager or an employee shall notify the city's police department and shall convey the false identification to such department.
