(A) Within 14 days after completion of all construction or maintenance of facilities, weather permitting, the permittee shall remove all excess material and restore all areas damaged or disturbed by such construction or maintenance, in a timely manner, to a condition that is reasonably the same as the condition existing prior to the work, and to the satisfaction of the city. This shall include restoration of entrances and side roads. Restoration of roadway surfaces shall be made using materials and methods approved by the Public Services Director. The required cleanup and repair of areas damaged or disturbed by the construction or maintenance of facilities in the city's rights-of-way may include backfilling, regrading, reseeding, resodding, concrete asphalt or decorative driveway replacement, replacement of trees or other landscaping in accordance with landscaping plans approved by the Engineer or Public Services Director, or any other requirement to restore the right-of-way to a condition substantially equivalent to that which existed prior to the commencement of the project.
(B) If weather or other conditions do not permit the complete restoration required by this section, the permittee shall, at its sole expense, temporarily restore the affected rights-of-way or property, and shall thereafter promptly undertake and complete the required permanent restoration when the weather or other conditions no longer prevent such permanent restoration.
