(A) Unless otherwise specifically provided in this section, no person shall park any vehicle on any municipal property, other than a municipally owned public parking lot, unless said person has specific business with the municipal government or has the permission of the City Administrator or Chief of Police or their designated representative.
(B) Unless otherwise specifically provided in this section, no person shall park any vehicle on any municipally owned public parking lot within the city between the hours of 2:00 a.m. and 5:00 a.m. without the permission of the City Administrator or Chief of Police or their designated representative.
(C) It shall be unlawful to park any vehicle at any time within the city limits upon an unpaved right-of-way or easement which is located immediately adjacent to a paved street, whether or not the paved street is framed, either by a concrete curb and gutter or a concrete ribbon, and the owner of any vehicle parked in violation of this paragraph shall be liable for damage to any unpaved right-of-way as a result of any such violation, as provided in § 71.01 of this title.
(D) Parking shall be permitted on the marked parking area within the public right-of-way on the west side of Michigan Avenue between 15th Street and 16th Street, subject to the following:
(1) Parking shall be permitted between the hours of 2:00 a.m. and 5:00 a.m.
(2) It shall be unlawful to park the following vehicles in this area at any time:
(a) Inoperable vehicles;
(b) Boats;
(c) Trailers;
(d) Camping trailers;
(e) Recreational vehicles;
(f) Vehicles that do not require license plates;
(g) Commercial vehicles, including any truck registration classification with an F license plate or above, or measuring more than eight feet in height or 24 feet long;
(h) Construction equipment, including but not limited to bulldozers, construction trailers, end-loaders, skid-steers, earth-movers, dump trucks, semi-tractor trailers, low trucks, hauling trailers;
(i) Vehicles with tools or ladders on the exterior of the vehicle.
(3) It shall be unlawful to park any vehicle in this area at any time within 12 hours after a snowfall of one inch or more has occurred.
(E) Parking shall be permitted on the marked parking area within the public right-of-way on the south side of 15th Street between Michigan Avenue and the westerly boundary line of the Stevenson School property, on the west side of Elder Lane between 16th Street and 20 feet north of the north edge of the east driveway of the Swartz School property, and on the east side of Patton Avenue between 16th Street and the north edge of the west driveway of the Swartz School property, subject to the following:
(1) It shall be unlawful to park the following vehicles in this area at any time:
(a) Inoperable vehicles;
(b) Boats;
(c) Trailers;
(d) Camping trailers;
(e) Recreational vehicles;
(f) Vehicles that do not require license plates;
(g) Commercial vehicles, including any truck registration classification with an F license plate or above, or measuring more than eight feet in height or 24 feet long;
(h) Construction equipment, including but not limited to bulldozers, construction trailers, end-loaders, skid-steers, earth-movers, dump trucks, semi-tractor trailers, low trucks, hauling trailers;
(i) Vehicles with tools or ladders on the exterior of the vehicle.
(2) It shall be unlawful to park any vehicle in this area at any time within 12 hours after a snowfall of one inch or more has occurred.
(F) The fines and penalties for a violation of divisions (A) and (C) of this section shall be as follows:
(1) If the penalty is paid directly to the city in an envelope provided by the Police Department within seven days from the receipt thereof, the penalty shall be $50.
(2) If a final notice is required, the penalty shall be $75.
(3) In the event that the penalty is not paid within 14 days after mailing of the final notice, the Police Department may issue a "Notice to Appear" requiring the violators to appear before the Circuit Court of the Eighteenth Judicial Circuit, DuPage County, Illinois. The penalty on the "Notice to Appear" shall be $100, plus court costs.
(4) If the person fails to appear, a warrant will be issued and prosecution shall commence against the violator. Upon conviction, the person, firm or corporation shall be fined not less than $100 nor more than $750 for each offense, and each separate offense will be deemed committed on each day during or on which a violation occurs or continues.
(5) In addition to any fine, any person operating, driving or moving any vehicle in violation of divisions (A) and (C) of this section is liable for all damage to city property that is sustained, as provided in § 71.01 of this chapter.
