(A) All meetings and hearings of the Planning and Zoning Commission shall comply with the requirements of the Open Meetings Act.
(B) Meetings and hearings of the Commission shall be scheduled for the first and third Tuesdays of each month at 7:30 p.m. In addition, the Commission may hold meetings and hearings at the call of the Chairperson and at such other times as the Commission or the corporate authorities may determine.
(C) All meetings and hearings required by this subchapter to be conducted by the Commission shall be open to the public. Any person may appear and testify at a hearing, either in person or by duly authorized agent or attorney. All testimony shall be given under oath. The Chairperson or Vice- Chairperson, or his or her designate, shall administer oaths and may compel the attendance of witnesses by subpoena. No meeting or hearing shall be held without a quorum of the Commission being present which shall consist of a majority of the members. All decisions arrived at by the Planning and Zoning Commission shall require a majority vote of all its members. Any formerly absent member who certifies that he or she has read the transcript of the proceedings before the Commission may vote upon any question presently before the Commission.
(D) The Commission shall keep minutes of its proceedings showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact. The Commission shall adopt its own rules of procedure not in conflict with this subchapter or with the resolutions and ordinances of the city or with the laws of the state.
(E) The concurring vote of four members of the Commission shall be necessary to reverse any order, requirement, decision, or determination of an administrative official, or to decide in favor of an applicant any matter upon which it is required to pass under ordinances of the city or to recommend any variation or to recommend any variation or modification in the Zoning Code.
(F) The Director of Community and Economic Development may, at any time, cancel any regular meeting and/or public hearing of the Planning and Zoning Commission, provided there is no item for discussion at said regular meeting and/or public hearing reflected in the proposed agenda, or that there is no quorum of members available; provided, however, that the Director of Community and Economic Development contacts each of the members of the Planning and Zoning Commission to inform them of the lack of subject matter for the meeting or hearing and that a majority of the quorum of the Planning and Zoning Commission does not object to the cancellation. When canceling a meeting, the city shall comply with the requirements of the Open Meetings Act.
