§ 33.007 AUXILIARY POLICE.
   (A)   Created. There is hereby created a special auxiliary service division of the Police Department of not to exceed 25 in number for the purpose of performing special police duties.
   (B)   Appointment. The Mayor, with and by the consent of the City Council, is hereby authorized and empowered to appoint auxiliary police officers as from time to time may be requested by the Chief of Police. Appointments to the auxiliary police shall be made annually and shall terminate on the last day of April of each year.
   (C)   Age of applicants. Applicants for the auxiliary police shall be at least 21 years of age.
   (D)   Rules and regulations. Persons appointed as auxiliary police officers shall be subject to rules and regulations governing regular police officers of the city and to such special rules and regulations as may from time to time be promulgated by the Chief of Police.
   (E)   Assignments; direction. The Chief of Police is hereby authorized and empowered to assign auxiliary police officers as the Chief may deem expedient for the everyday and emergency operations of the Police Department. Auxiliary police officers shall at all times during the performance of their duties e subject to the direction and control of the Chief of Police.
   (F)   Termination of appointment. The Mayor may remove any auxiliary police officer, on any written charge, whenever the Mayor is of the opinion that the interests of the city demand such removal. The Mayor shall report the reasons for the removal to the corporate authorities at a meeting to be held not less than five nor more than ten days after the removal. If the Mayor fails or refuses to report to the corporate authorities the reasons for the removal, or if the corporate authorities by a two- thirds voted of all members authorized by law to be elected disapprove of the removal, the auxiliary police officer thereupon shall be restored. The vote shall be by yeas and nays, which shall be entered upon the journal of the corporate authorities. Upon restoration, the auxiliary police officer shall give a new bond and take a new oath of office. No auxiliary police officer shall be removed a second time for the same offense. Any person whose appointment has been terminated shall immediately return to the Chief of Police the commission card of appointment, badges, cap pieces and other Police Department property held by him or her.
   (G)   Compensation. The hourly wage rate for auxiliary police officers of the city shall be such as may from time to time be prescribed by the City Council. If any person requests the services of an auxiliary police officer or officers for any specific purposes, these services must be approved by the Chief of Police according to the city's Secondary/Off-Duty Employment and Special Details Policy, as amended from time to time, as prescribed by the City Council.
   (H)   Physical condition of applicants. Applicants for the auxiliary police shall be in excellent physical and mental condition. All applicants shall furnish an affidavit from a registered medical doctor attesting to their physical condition prior to acceptance of application.
   (I)   Designation of command officers. The Chief of Police may recommend to the Mayor and City Council the name of one member for designation as auxiliary division commander with the auxiliary rank of sergeant.
   (J)   Fitness for duty. Any auxiliary officer who is admitted to any medical institution for any period over 24 hours, or who is injured to such an extent as to be unable to perform the duties of an auxiliary officer shall, prior to reporting for duty, obtain from a licensed physician an affidavit attesting to the auxiliary officer's good health and stating that such auxiliary officer is fit to return to duty.
   (K)   Reappointment physical. Prior to the last day in April of each year, each auxiliary officer shall obtain, at his or her own expense, an affidavit from a registered medical doctor attesting to such auxiliary officer's good health and stating that such auxiliary officer is fit to perform his or her duties.
   (L)   Powers and duties; identification.
      (1)   Auxiliary police officers shall not be members of the regular Police Department of the municipality. Auxiliary police officers shall not supplement members of the regular Police Department of any municipality in the performance of their assigned and normal duties, except as otherwise provided in this division.
      (2)   Auxiliary police officers shall only be assigned to perform the following duties in a municipality:
         (a)   To aid or direct traffic within the municipality;
         (b)   To aid in control of natural or manmade disasters; and
         (c)   To aid in case of civil disorder as directed by the Chief of Police.
      (3)   Notwithstanding the foregoing, when it is impractical for members of the regular Police Department to perform their normal and regular police duties, the Chief of Police may assign auxiliary police officers to perform such normal and regular police duties.
      (4)   Identification symbols worn by auxiliary police officers shall be different and distinct from those used by members of the regular Police Department.
      (5)   Auxiliary police officers shall not carry firearms, except with the permission of the Chief of Police and while in uniform and in the performance of their duties.
   (M)   Training. Before entering upon any of their duties, auxiliary police officers shall receive a course of training in the use of weapons and other police procedures appropriate for the exercise of the powers conferred upon them under this section. The training and course of study shall be determined and provided by the corporate authorities. Before being permitted to carry a firearm, however, an auxiliary police officer must have the same course of training as required of peace officers under Section 2 of the Peace Officer Firearm Training Act.
   (N)   Background check. Before the appointment of an auxiliary police officer, the person's fingerprints shall be taken, and no person shall be appointed as an auxiliary police officer if that person has been convicted of a felony or other crime involving moral turpitude.
   (O)   Line of duty compensation. The Line of Duty Compensation Act shall be applicable to auxiliary police officers upon their death in the line of duty as described in this section.
