No person shall have in his possession any property, instrument or device designed or adopted for use in any gambling activity. Any such property, instrument or device is hereby declared a public nuisance and may be summarily seized by any peace officer. Property so seized shall remain in the custody of the seizing agency, subject to order by a court exercising proper jurisdiction. (Ord. 605-04, 6-8-2004)
