The city council shall either approve the application and grant the license or deny the application and refuse to grant the license. The license shall not be granted if a person who has an interest in the business has:
A. Been convicted of a felony within the last ten (10) years;
B. Been convicted of five (5) misdemeanors, the last of which was within five (5) years;
C. Been convicted of or forfeited bail for a crime involving gambling within the last five (5) years;
D. Been involved, directly or indirectly, in a forfeiture proceeding regarding a gambling device as defined in the Oregon Revised Statutes where such gambling device has been ordered destroyed or a bond has been forfeited in lieu of the gambling device being destroyed within the last five (5) years;
E. Given false or misleading information or omitted information requested in the application;
F. Had a license in the name of the person revoked or suspended three (3) times by the Oregon liquor control commission, the last of which was in the last five (5) years;
G. Had a license previously issued by the city revoked pursuant to this chapter; or
H. Been convicted of violation of a law or ordinance involving moral turpitude. (Ord. 605-04, 6-8-2004)
