A. Cardroom License, Council Approval For Granting: No person, firm or corporation shall engage in, carry on, maintain or conduct, or cause to be engaged in, carried on, maintained or conducted, a cardroom in the city where social games are played between private parties and items of value or money may be exchanged based upon the winning or losing of the game without having obtained a valid license from the city. Licenses shall be granted only on approval of the city council.
B. Applicant, Owner Of Table: A person making application for a cardroom license shall be the sole and exclusive owner of the table or tables used or to be used in the cardroom.
C. Signing Of Application: If the cardroom to be licensed is owned by a corporation, the license shall be issued in the name of the corporation on written application of its president, vice president, secretary or treasurer. If the cardroom to be licensed is owned by a partnership, all partners shall sign the written application and the license shall be issued in the partnership name. If the cardroom to be licensed is owned by a limited liability company, all members of the limited liability company shall sign the written application and the license shall be issued in the name of the limited liability company. If the cardroom to be licensed is owned by a trust, all trustees thereof shall sign the written application and the license shall be issued in the name of the trustees.
D. Contents Of Application; Investigation Fee:
1. An applicant for a cardroom license shall submit an application under oath to the city recorder.
2. The application shall include the true names and addresses, personal histories and business experiences, fingerprints, photographs and past criminal records of all persons who are financially interested in the business, the name of the business or establishment, the number of tables the applicant seeks to have licensed, and any other matters the city manager considers necessary. The term "person financially interested" includes all persons who share in the profits of the business.
3. The application also shall be accompanied by a nonrefundable investigation fee as established by resolution of the city council. (Ord. 605-04, 6-8-2004)
