11-1-5: ADDITIONAL REMEDIES:
   A.   In addition to the penalties provided in section 11-1-3 of this chapter, the City may sue in a court of competent jurisdiction to obtain a judgment for a fee due under this chapter and enforce collection of the judgment by execution.
   B.   The City may seek an injunction to prohibit a person from erecting, constructing, enlarging, altering, repairing, moving, improving, removing, converting, demolishing, equipping, using, occupying or maintaining any building or structure without complying with this chapter.
   C.   In an action authorized by this section, if the City prevails, it shall recover reasonable attorney's fees to be set by the court in addition to its costs and disbursements. These fees are recoverable at all levels of trial and appeal.
   D.   Whenever a fee required by this chapter is not paid when due, the City Recorder shall add as a penalty to the fee an amount equal to nine percent (9%) of the fee for each month or part thereof during which the fee and accumulated penalty amounts remain unpaid. The total amount of penalties shall not exceed one hundred percent (100%) of the original fee. (Ord. 659-18, 10-9-2018)
