The franchisee may subcontract with others to provide a portion of the service where franchisee does not have the necessary equipment for service. Such a subcontract shall not relieve the franchisee of total responsibility for providing and maintaining service and for compliance with this chapter. The subcontractor shall abide by all the terms and conditions of this chapter, and the subcontractor shall have no claim or right of action whatsoever against the city. Except where emergency service is provided by a subcontractor, such subcontract shall be in writing, shall be filed with the city manager for any service extending more than ninety (90) days, and shall provide that the subcontractor shall have no claim or right of action whatsoever against the city.
