8-3-1: DEFINITIONS:
The following words and phrases, when used in this chapter, shall have the meanings respectively ascribed to them. Unless the context specifically indicates otherwise, the meanings of terms used in this chapter shall be as follows:
APARTMENT HOUSE: Any building for the housing of three (3) or more families at one time.
BOD (Denoting Biochemical Oxygen Demand): The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at twenty degrees Celsius (20°C), expressed in milligrams per liter. The laboratory determinations shall be made in accordance with procedures set forth in "Standard Methods".
BIOSOLIDS: Any discharge of water, sewage, or industrial waste which, in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than fifteen (15) minutes, more than five (5) times the average twenty four (24) hour concentration of flows during normal operation.
BUILDING: A structure which is built for permanent use; a house, garage, shed, store, etc.
BUILDING DRAIN: That part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet (5') outside the inner face of the building wall.
BUILDING SEWER: The extension from the building drain to the public sewer or other place of disposal.
EDU OR EQUIVALENT DWELLING UNIT: The basic cost unit for various fees and charges imposed in connection herewith. In the event that a given site, facility or person receiving service from the city shall have at a single service location more than one EDU, whether of the same or different type, a charge shall be imposed for each EDU.
ERU OR EQUIVALENT RESIDENTIAL UNIT: The basic cost unit for various fees and charges imposed in connection herewith. In the event that a given site, facility or person receiving service from the city shall have at a single service location more than one ERU, whether of the same or different type, a charge shall be imposed for each ERU.
GARBAGE: Solid wastes from the domestic and commercial preparation, cooking and dispensing of food, and from the handling, storage and sale of produce.
GREASE INTERCEPTOR: A vault with a minimum capacity of between five hundred (500) and seven hundred fifty (750) gallons that is located on the exterior of the building. The vault includes a minimum of two (2) compartments, and flow between each compartment is through a ninety degree (90°) fitting designed for grease retention. The capacity of the interceptor provides adequate residence time so that the wastewater has time to cool, allowing any remaining grease not collected by the traps time to congeal and rise to the surface where it accumulates until the interceptor is cleaned.
GREASE TRAP: A small reservoir built into the wastewater piping a short distance from the grease producing area. Baffles in the reservoir retain the wastewater long enough for the grease to congeal and rise to the surface.
GROCERY STORE: A store designated primarily for the purpose of selling groceries and meats from a meat counter, which has at least one walk-in type cooler for the storage of meats.
IDAHO STANDARDS FOR PUBLIC WORKS CONSTRUCTION (ISPWC): The set of standards used by the city of Nyssa for all public works construction.
INDUSTRIAL USER: Industrial manufacturing processes, trade or business as distinct from sanitary sewage.
INDUSTRIAL WASTE: The liquid wastes from industrial manufacturing processes, trade or business as distinct from sanitary sewage and contains:
   A.   A five (5) day biochemical oxygen demand greater than three hundred (300) parts per million by weight; or
   B.   More than three hundred fifty (350) parts per million of suspended solids by weight; or
   C.   Having an average daily flow greater than 0.20 percent of the average daily design flow of the city wastewater treatment plant.
INSPECTOR: The supervisor of sewer and/or water, or authorized deputy, agent or representative.
MAY: "May" is permissive; "shall" is mandatory.
MEDICAL CLINIC: An office building used by any branch of the healing arts which is occupied by more than one professional person engaged in the particular profession.
MILLIGRAM PER LITER: A weight to weight ratio; the milligram per liter value multiplied by the factor 8.345 shall be equivalent to pounds per million gallons of water.
NATURAL OUTLET: Any outlet into a water source, pond, ditch, lake or other body of surface water or groundwater.
POTW: Publicly owned treatment works.
PERSON: Any individual, firm, company, association, society, corporation or group.
pH OR THE LOGARITHM (BASE-10) OF THE RECIPROCAL: The logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
PRETREATMENT: The method by which an industry can comply with local waste discharge ordinances and also federal and state regulations, protecting the environment, the POTW agency's facilities and personnel, and the local community from adverse effects due to industrial waste discharges. The process designed to remove pollutants from waste streams prior to discharge to the local sewer system.
PRODUCT: Any discharge of water, sewage, or industrial waste which, in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than fifteen (15) minutes, more than five (5) times the average twenty four (24) hour concentration of flows during normal operation.
PROPERLY SHREDDED GARBAGE: The wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch (1/2") in any dimension.
PUBLIC SEWER: A sewer in which all owners of abutting properties have equal rights and is controlled by public authority.
ROOMING HOUSE: Any building permitting the rental of one or more rooms, not classified as apartments, where cooking or eating facilities are not available to the renting tenants.
SANITARY SEWER: A sewer which carries sewage and to which stormwater, surface water and groundwater are not intentionally admitted.
SERVICE AREA: Being within three hundred feet (300') of the sewer main.
SERVICE CONNECTION: The sewer between the property line and the lateral, main or trunk sewer of the city sewer system.
SEWAGE: A combination of the water carried wastes from residences, business buildings, institutions, and industrial establishments, together with such groundwater, surface water and stormwater as may be present.
SEWAGE TREATMENT PLANT: Any arrangement of devices and structures used for treating sewage.
SEWAGE WORKS: All facilities for collecting, pumping, treating and disposing of sewage.
SEWER: A pipe or conduit for carrying sewage.
SHALL: "Shall" is mandatory; "may" is permissive.
SLUG: Any discharge of water, sewage, or industrial waste which, in concentration of any given constituent or in quantity of flow, exceeds for any period of duration longer than fifteen (15) minutes, more than five (5) times the average twenty four (24) hour concentration of flows during normal operation.
STANDARD METHODS: The examination and analytical procedures set forth in the most recent edition of "Standard Methods For The Examination Of Water, Sewage, And Industrial Wastes", published jointly by the American Public Health Association, the American Water Works Association and the Federation Of Sewage And Industrial Wastes Associations.
STORM DRAIN (Sometimes Termed STORM SEWER): A sewer which carries stormwater and surface water and drainage, but excludes sewage and industrial wastes, other than unpolluted cooling water.
SUPERMARKET: A store designated primarily for the purpose of selling groceries and meats from a meat counter, which has at least one walk-in type cooler for the storage of meats.
SUPERVISOR: The city supervisor of sewer and/or water, or authorized deputy, agent or representative.
SURCHARGE: The assessment in addition to the service charge which is levied on those persons whose wastes are greater in strength than the concentration values established as representative of normal sewage.
SUSPENDED SOLIDS: Solids that either float on the surface of, or are in suspension in, water, sewage or other liquids, and which are removable by laboratory filtering. Quantitive determination of suspended solids shall be made in accordance with procedures set forth in "standard methods".
UNPOLLUTED WATER OR LIQUIDS: Any water or liquid containing none of the following: free or emulsified grease or oil; acids or alkalies; substances that may impart taste and odor or color characteristics; toxic or poisonous substances in suspension, colloidal state or solution; odorous or otherwise obnoxious gases. It shall contain not more than 1.0 milligram per liter by weight of dissolved solids; not more than 2.0 milligrams per liter of suspended solids or biochemical oxygen demand. Analytical determinations shall be made in accordance with procedures set forth in "standard methods".
USER: Any property owner of any property connected to, or which is, by this chapter, required to be connected with the sewer facilities of the city, and the property owner, will be held responsible for the payment of said charges when due.
WASTEWATER TREATMENT PLANT: Any arrangement of devices and structures used for treating sewage.
WATERCOURSE: A channel in which a flow of water occurs, either continuously or intermittently. (Ord. 624-08, 8-12-2008)
