8-2-16: WATER RATES AND CHARGES; RESPONSIBILITY:
   A.   Rates Set By Resolution: Rates and charges for metered and nonmetered water use, irrigation charges, charges for water connections, installation of meters, service laterals and all other water department fees and charges shall be set from time to time by resolution of the city council. (1962 Code § 2-1-16)
   B.   Factors In Determining Rates And Charges: In determining the rates and charges to be assessed under this section, the city council shall take into account all direct or indirect costs incurred by the city in order to deliver water. The actual cost of delivering water includes the average cost or an allocated portion of the total amount of the actual cost of making the water available to a water connection, whether stated as a minimum, fixed or variable amount. Such actual cost also includes, but is not limited to, the costs of labor, materials, supplies, equipment rental, property acquisition, permits, engineering, financing reasonable program delinquencies, return on investment, required fees, insurance, administration, accounting, depreciation, amortization, operation, maintenance, repair or replacement and debt service, including debt service payments or payments into a reserve account for debt service and payment of amounts necessary to meet debt service coverage requirements.    C.   Occupant Responsible For Payment: The occupant of premises served by City water service shall be responsible for all charges for City water service. "Occupant" means the person or entity entitled to occupy the property. (Ord. 634-11, 11-15-2011)
