7-6-3: LIGHTING SERVICE CHARGE RATE:
   A.   Amount Set By Resolution: On or before July 1, 1991, and annually thereafter, the city council shall, by resolution, set the amount of the monthly street lighting service charge to be levied on all occupied residential, commercial, and industrial properties within the city for the succeeding fiscal year. Such monthly service charges shall as nearly as practicable reflect the ratable portion or share that each property must bear to the actual cost to the city of providing lighting for the streets, alleys, and other public places. In setting such monthly service charge, the city shall consider, in the case of each occupied property, such factors as the size of the parcel, the intensity of the lighting provided, the use made of the property and any other relevant factors or information with respect to each property. The monthly service charge shall not be disproportionate between occupied properties of the same class of property within the city; that is, residential, commercial and industrial, unless there is a clearly identified basis for making a distinction between one occupied property and other occupied properties of the same class.
   B.   Actual Cost Considered: The actual cost to the city of providing lighting for the streets, alleys and other public places in the city shall include the actual cost for power poles, lights, materials or services billed to the city, as well as all other actual costs including, but not limited to, the costs of labor, materials, supplies, equipment rental, property acquisition, permits, engineering, financing reasonable program delinquencies, return on investment, required fees, insurance, administration, accounting, depreciation, amortization, operation, maintenance, repair or replacement and debt service, including debt service payments or payments into reserve account for debt service and payment of amounts necessary to meet debt service coverage requirements.
