7-2-1: CONSTRUCTION REQUIRED:
   A.   Improvement Defined: For purposes of this chapter, an "improvement" shall be deemed to mean any addition, alteration, remodel or betterment to existing structures, including landscaping, on a single tax lot, the cost of which shall exceed fifty percent (50%) of the market value of the tax lot so improved, as determined by comparing the cost of the improvement reported on the application for a building permit with the market value of the tax lot as determined by the Malheur County assessor immediately prior to commencement of construction of the improvement.
   B.   Sidewalk, Curb And Gutter:
      1.   Each property owner within the city shall be required to construct and maintain a sidewalk, and if none are existing, to construct and maintain curb, gutter and storm drainage along all portions of the lot or tract which abuts on a city street at the time of construction of an improvement thereon.
      2.   Corner lots shall have a sidewalk and gutter constructed along both streets.
      3.   Interior lots shall have a sidewalk and curb extending the entire length of the frontage of the lot or tract abutting the street.
   C.   Storm Drainage:
      1.   Storm drainage, if deemed necessary by the city, shall be provided by the property owner. The city shall provide catch basins and infiltrators. Installation shall be to city specifications.
      2.   The property owner is also responsible for replacing existing asphalt to the new gutter line. (Ord. 01-598, 12-11-2001)
