6-3-1: ALCOHOLIC BEVERAGES AND ILLEGAL DRUGS:
   A.   Possession, Storage And Consumption In Certain Places:
      1.   Open Containers: Except as provided in subsection A2 of this section, no person shall possess any open containers of alcoholic beverage or shall drink or consume any alcoholic beverage in or upon public places, including, but not limited to, the city parks, streets, alleys, sidewalks, doorways or alcoves, or any public or private parking lots or vacant lots within the city.
      2.   Permit For Possession And Consumption In Public Parks: The city council may, by resolution, establish a process and criteria for issuance of permits to possess, drink and/or consume alcoholic beverages in or upon public parks, but not city buildings or vehicles described in subsection A3 of this section.
      3.   Prohibited In City Owned Buildings, Vehicles: It shall be unlawful for any city employee or other person to possess, store, use or consume any alcoholic beverages and/or illegal drugs in buildings owned or occupied by the city, as well as all vehicles owned or operated by city employees or volunteers.
      4.   Law Enforcement Processing And Storage: The city police, the Malheur County sheriff, the Oregon state police, and all federal law enforcement officers may possess and store alcoholic beverages and illegal drugs while transporting the same and while holding the same in a designated evidence locker or storage area on or in city property; and provided, that such possession and storage is within the official duties of the law enforcement officer charged with the responsibility for possession and storage.    B.   Marijuana Possession: It shall be unlawful for any person to have in his possession, marijuana in an amount consisting of less than one avoirdupois ounce. For purposes of this section, "marijuana" shall be defined as including the leaves, stems, flowers and seeds of the plant cannabis family Moraceae. The penalty for a conviction of possession of less than one ounce of marijuana shall be punishable by a fine of not more than two hundred sixty dollars ($260.00). (1962 Code § 5-1-19; amd. 2014 Code)
   C.   Minor In Possession: It shall be unlawful for any person under the age of twenty one (21) years to have alcoholic liquor in his possession. For the purpose of this subsection, "possession" shall include consumption. (1962 Code § 5-1-20)
