6-2-3: DOG LICENSE REQUIRED; EXCEPTIONS; TAG AND COLLAR:
   A.   License Required; Issuance:
      1.   License Required; Proof Of Rabies Vaccination: A license shall be required for all dogs that have a set of permanent canine teeth. Persons owning, possessing, or keeping a dog which has a set of permanent canine teeth shall immediately, within thirty (30) days after such person becomes the owner, possessor, or keeper of such a dog, or within thirty (30) days after such dog acquires a set of permanent canine teeth, procure from the ordinance control officer, or his/her agent, a license for the dog. A license will only be issued upon proof that the dog has current rabies vaccination.
      2.   Agent Fees: An agent, as set forth in this section, who is authorized by the city to provide Nyssa dog licenses to the public on behalf of the city, shall be compensated at a rate determined by city council resolution.
   B.   Special License For More Than Three Dogs:
      1.   Application; Consent Of Adjacent Property Owners; Conditions:
         a.   It is unlawful to keep, maintain, harbor or possess upon any one premises more than three (3) dogs unless the owner makes special application to do so. This does not, however, permit the operation of a kennel or other commercial operation.
         b.   Application to house more than three (3) dogs on a noncommercial basis must be made to the city and must be accompanied by the written consent of at least seventy five percent (75%) of all persons in possession of premises within one hundred feet (100') of the premises upon which application is being made.
         c.   A fee to be determined by city council resolution shall accompany the application.
         d.   All dogs covered by the provisions of this section shall be confined upon the property or under leash at all times; provided, however, that this shall not apply to dogs under three (3) months of age.
      2.   License Term; Review; Complaints:
         a.   The permit will allow the keeping of over three (3) dogs for a three (3) year period. The permit will be reviewed by the police department at the conclusion of three (3) years.
         b.   If during that period there have been no dog nuisance complaints associated with the premises, the permit will be extended for another three (3) year period, indefinitely.
         c.   If there has been a dog nuisance complaint, the applicant will be required to obtain the written consent of at least seventy five percent (75%) of all persons in possession of premises within one hundred feet (100') of the premises upon which application is being made.
   C.   Handicapped Persons; Exception To License Fee: No license fee shall be required to be paid for a dog owned by a blind person or handicapped person who uses it as a guide or trained helper. A license shall be issued for such dog upon the filing with the ordinance control officer or agent an affidavit by the handicapped person showing the dog to come within this exemption.
   D.   Collar And Tag: Every individually licensed dog must wear a collar with the license tag attached at all times. (Ord. 630-10, 1-11-2011)
