§ 913.03 DEFINITION OF “USER”.
   (a)   For purposes of this article, USER refers to any person, firm, corporation or governmental entity of any kind owning any building or structure, whether residential, commercial, governmental or otherwise, which reside or are located within the town limits of the Town of Nutter Fort.
   (b)   Subject to such reasonable regulations as may be decided by the Treasurer or Recorder, the record owner of the property upon which a single-family residence is situated shall be considered the user of municipal service rendered for the benefit of said property and the record owner shall be liable to the Town of Nutter Fort for charges. Landlords, and their tenants or occupants of the residential units of a multi-family dwelling or apartment house, shall be considered the “users” of such municipal services and shall be liable to the Town of Nutter Fort for said charges. Persons doing business as partners in a business establishment shall be jointly and severally liable for said charges. However, in the event that a residential unit of a multi-family dwelling or apartment house is unoccupied, then the owner of record of the property upon which said multi-family dwelling or apartment is situated shall be considered the user of the residential services and shall be liable to the Town of Nutter Fort for said charges. Subject to such reasonable regulations as may be promulgated by the Treasurer or Recorder, the owner of record of the property upon which such multi-family dwelling or apartment house is situated shall be charged with the responsibility of collecting charges imposed by this article from tenants or occupants of such dwelling units or apartments and properly remitting same to the Treasurer or Recorder and shall be liable to the Town of Nutter Fort in the amount of said charges.
   (c)   MULTI-PURPOSE (MULTI-USE) PROPERTIES shall be defined as those which are divided. For example: single or multi-family dwellings in addition to business/commercial usage, or multiple business/commercial usage within the same property. In said examples, the business owner/operator shall be liable to the Town of Nutter Fort for said charges based on established fee schedule as outlined in § 913.01 of this article. However, should said business move or be dissolved, the owner of the property in which the business was situated shall be liable for applicable residential or commercial fees, as defined.
