§ 757.11 FAILURE TO OBTAIN LICENSE.
   Any licensee authorized to sell alcoholic liquors, as provided by W.Va. Code § 60-7-3, who shall do so or who shall permit such sales to be made within the corporate limits of the town without first having obtained a town license therefor shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than $500, or by imprisonment for a period not to exceed 30 days, or by both such fine and imprisonment. The Mayor shall have jurisdiction to hear and determine all cases brought hereunder. For the purposes of this section, the licensee shall be deemed to have permitted any sale of alcoholic liquors which take place on the licensed premises and shall be subject to the penalty provisions of this section for any sales so made.
