(a) Council hereby finds that the purposes of the West Virginia Governmental Ethics Act, being W.Va. Code §§ 6B-1-1 et seq., have reasonable, necessary and appropriate application to matters involving all elected and appointed municipal officials and employees, whether full or part time, who derive a salary, payment of wages or other direct remuneration from the municipality, and does now hereby affirm, ratify and adopt the state- defined purposes as being the same purposes of this article, without specifically republishing the state purposes herein.
(b) Council further hereby finds that for the purpose of assisting in the administration of the provisions of this article, that various statutory sections of the aforesaid state act shall be hereby expressly adopted and incorporated as provisions of this article, except as otherwise expressly provided herein, and which such state statutory sections specifically hereby adopted and incorporated herein are as follows:
(1) W.Va. Code §§ 6B-1-1 through 6B-1-5; and
(2) W.Va. Code § 6B-2-5.
(c) Notwithstanding the affirmation and adoption of the purposes of the state act and further the specific adoption of the selected, statutory sections which are immediately hereinbefore set forth in § 111.02 of this article, the Council specifically finds that certain statutory provisions of the aforesaid state act are either inapplicable to the administration of this article or would otherwise be unduly burdensome for the town to require and administer, and specifically, the Council finds that the purposes of the state act and of this article can be effectively executed at the municipal level without the specific adoption and incorporation of the statutory provisions of W.Va. Code §§ 6B-2-6 and 6B-2-7 respecting financial disclosure, and W.Va. Code Art. 6B-3 relating to regulation and registration of lobbyists, and which such statutory provisions the Council hereby expressly opts not to include as provisions of this article, and affirmatively elects that such provisions shall not apply to this municipality and its officers and employees.
