(a) Competitive bidding is required for the acquisition of materials, supplies, services or equipment, the cost of which is expected to exceed the sum of $50,000.
(b) Council shall have the right to accept or reject any or all bids and to waive any informalities therein and in doing so Council is authorized to consider, not only the amount of each bid, but the responsibility of the bidder, including the bidder’s capital resources, skill and judgment and the anticipated quality of materials and performance of services and contracts.
(c) Nothing herein contained shall be deemed to require competitive bidding absent a specific determination by Council that certain materials, supplies, services or equipment should be acquired by competitive bidding and likewise nothing herein contained shall be deemed to waive competitive bidding when the same is otherwise required by law.
(d) In the event an emergency occurs and a purchase of equipment or materials must be made immediately, the Mayor would be authorized to make this decision. In this event, the bidding process would not apply. The Mayor would notify the Council as soon as possible or at the next Council meeting of the said purchase.
(e) Competitive bidding for attorney services will not be required. Town Council may authorize the Mayor to contact a specified attorney to provide services for the town as needed.
