(a) No person, other than a licensed peddler, shall demonstrate, sell or offer for sale any goods, wares or merchandise from any vehicle, or from any box, basket, bag or container, upon streets of the City. No person, other than a licensed peddler selling from a vehicle, shall stand or go upon a roadway for the purpose of demonstrating, selling or offering for sale any goods, wares, newspapers or merchandise, or of distributing or handing out bills, cards, leaflets, samples of merchandise or other similar items. No person, whether licensed as a peddler or not, shall demonstrate, sell or offer for sale, upon any street within the congested or closely built up portion of the City, any goods, wares, or merchandise, other than newspapers.
(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
