131.01 CURFEW WHEN A STATE OF EMERGENCY HAS BEEN DECLARED BY THE MAYOR.
   (a)   Curfew for State of Emergency.
      (1)   This section shall only apply when it has been declared by the Mayor of Norwood that the City is under a State of Emergency.
      (2)   The curfew applies to all individuals, regardless of age, except as otherwise stated.
      (3)   The curfew shall not apply to members of the Norwood Police Department, Norwood Fire Department (if on duty), other emergency personnel who are assisting Norwood safety forces at the request of the City Administration, and members of the Administration of the City who are engaged in the commission of their lawful duties.
   (b)   Offenses and Violations. Any person commits an offense if he/she remains in any public place, on the premises of any establishment, or on any public street within the City during curfew hours as established by the Mayor or his representative.
   (c)   Defenses. It is a defense to prosecution under this ordinance if the person was going to or coming from work or going for medical treatment due to an emergency.
   (d)   Penalty. Any person who violates curfew shall be guilty of a misdemeanor of the first degree punishable by not more than one thousand dollars ($1,000) and/or six months in jail.
