(a) Purpose. The purpose of this ordinance banning registered sex offenders from membership and day passes at Norwood Recreational Facilities is to try to protect the members and guests at all Norwood Recreation Facilities from any sex-related offenses, by separating registered sex offenders from members and guests at all Norwood Recreational Facilities. The determinations and intent to provide information to protect public safety are the same as those determined, recognized and found by the Ohio General Assembly in Ohio Revised Code §2950.02, and it is the Council's intent to protect the safety and general welfare of the people who use and provide all Norwood Recreational Facilities.
(b) Memberships of Registered Sex Offenders Denied, or Rescinded, and Day Passes at Norwood Recreation Facilities Denied to Registered Sex Offenders. Any membership in the Norwood Recreation Facilities shall be denied, or if already issued, rescinded, and the membership fee refunded, for any individual who, pursuant to Ohio R.C. Chapter 2950, has a duty to register in Ohio, and who appears, or should appear, on the Sex Offender Registry maintained by the Ohio Attorney General or the Hamilton County Sheriff's Office or the National Sex Offender Registry. The required application for membership shall include an inquiry about whether the applicant, or if applying for a two-person or family membership, any adult family member of the applicant, is an individual presently required to register as a sex offender. The Norwood Recreation Department shall examine the membership applications for all individuals applying for and holding memberships at the Norwood Recreation Facilities to determine whether such individuals are mandated to register as sex offenders in the State of Ohio. In such event, the Norwood Recreation Department shall inform the individual that the membership application is denied or rescinded as to any family member who is required to register as a sex offender, except those adjudicated as a sex offender in Juvenile Court, and any prorated fees for such member's application shall be refunded to any such individual by the Recreation Department. The Recreation Director or the designee of the Recreation Director shall adopt reasonable rules to calculate the amount of refund owed to such individual for any unsued portion of the membership, in the event that such individual is a member of a family or other multiple individual membership at the Norwood Recreation Facilities. The term "Norwood Recreation Facilities", as used in this section shall apply to all Norwood Recreation Department facilities which are accessed by Norwood Recreation Facilities Membership Cards. No individual who is banned from membership by this section shall be presented at Norwood Recreation Facilities which require membership cards. This ban applies to all individuals who request guest passes to Norwood Recreation Facilities as well as all individuals who apply for annual or seasonal memberships. Violation of this restriction by any individual who appears, or should appear on the Sex Offender Registry maintained by the Ohio Attorney General or the Hamilton County Sheriff's Office or the National Sex Offender Registry shall constitute Criminal Trespass, a violation of Codified Ordinance 541.05 (Criminal Trespass).
