1735.01 INSPECTION AND LABORATORY FEES; PURPOSE.
   (a)    Inspection Charges. Every owner of a milk or ice cream plant located within the City, and every owner of a milk or ice cream plant located outside the City, which handles milk, milk products or ice cream for distribution, in whole or in part within the City, shall pay to the City Treasurer an inspection charge of two and one-half cents (2-1/2¢) for each one hundred pounds of milk, except emergency milk and cream, received by him from milk producers having a Norwood Board of Health license in good standing. Emergency milk and cream is milk and cream brought in from outside the regular City inspection area in time of a shortage or emergency by special permit from the Health Commissioner.
   Owners or operators of milk plants located beyond the corporate limits of the City, and under the active supervision of other governmental health authorities, who apply for a milk plant license, shall not be required to pay the inspection fee herein provided if there exist in each case, each and all of the following terms and stipulations, as follows:
      (1)    If their milk and milk products are produced, collected, processed, stored and prepared for distribution under regulations and conditions equivalent or superior to the requirements of the Board of Health of the City; and
      (2)    If such regulations and conditions are being efficiently and effectively enforced by the governmental health authorities charged with the primary responsibility therefor as determined by U. S. Public Health Service survey, survey by this authority, or both, if deemed advisable by the Health Commissioner; and
      (3)    If their milk and milk products used in the manufacture of ice cream, ice cream mix, frozen custard, sherbet and similar frozen desserts have a U. S. Public Health milk sanitation survey rating of ninety percent or better; and
      (4)    If such governmental unit or agency reciprocates with the City by waiving inspection fees on all milk or milk products from milk plants undergoing active inspection pursuant to the terms of this section by the Health Commissioner.
   The intention and purpose of this section is to prevent the unnecessary duplication of inspection fees and inspection services by governmental units and agencies; to prevent or minimize the erection of trade barriers between states and municipalities and to efficiently, effectively and economically carry out and permit the carrying out of a comprehensive, cooperative and integrated milk and frozen desserts control program in and about the Greater Cincinnati, Ohio metropolitan area, which includes Norwood and other municipalities in northern Kentucky.
   (b)    Laboratory Bacteriological Examination Fee. Every owner of a milk or ice cream plant located within the City, and every owner of a milk or ice cream plant located outside the City, which handles milk, milk products, or ice cream for distribution, in whole or in part, within the City shall pay annually a bacteriological examination fee of eighteen dollars ($18.00) and shall otherwise comply with the rules and regulations of the Norwood Board of Health.
