(a) Jurisdiction and Exceptions. The Ohio Board of Building Appeals established by Ohio R.C. 3781.19 is the agency which shall conduct all adjudication hearings which are within the authority of the Board of Building Standards as specified by Rule 4101:2-1-09 of the Ohio Administrative Code. This applies to all buildings except as follows:
(1) Single-family, two-family and three-family dwellings houses which are not constructed of industrialized units, except where the context specifies mandatory applicability; of the Ohio Building Code (OBC).
(2) Buildings owned by and used for a function of the United States government.
(3) Existing buildings where their location, parts, equipment and other items do not constitute a serious hazard.
(b) Statutory Compliance. Membership, procedures and decisions of the Ohio Board of Building Appeals shall conform to the requirements of Ohio R.C. 3781.19.
